Texas Real Estate Contracts

What to Expect When Buying a Home

 

These are a few of the most common contracts, amendments, and addendums that you might be presented with when buying a home in Texas. ALL Texas REALTORS® use the same forms.

I have found that it is always a good idea to let my clients take their time to read over the contracts before we are ready to make an offer. That way they can have some questions ready in advance or decide if they would like to present the contracts to their attorney. I don't like being pressured into signing a contract without reading and understanding everything in it. Neither do my clients.

The First contract (1-4 Family Residential Contract) is the one an offer is presented with. The contract describes the property, how much it is being sold for, disclosures/liabilities, and who does what and when. It is the fundamental instrument in the Real Estate transaction.

As public records, the contract forms adopted by the Texas Real Estate Commission are available to any person.

However, TREC contract forms are intended for use only by licensed real estate brokers or salespersons who are trained in their correct use. Mistakes in the use of a form may result in financial loss or a contract which is unenforceable.

If you are obtaining the forms for possible use in a real estate transaction, you should contact a real estate licensee or an attorney for assistance. TREC cannot provide legal advice to the public on private contractual matters.

TREC does not promulgate listing or buyer representation agreements, property management contracts, forms for commercial property, or residential leases (other than temporary residential leases used in connection with a sale). Contact your attorney or a trade association for such forms.
